Terms and Conditions of Colleins B.V.

1. Definitions

For the purposes of these terms and conditions, the following definitions apply:

  • Colleins, we, us: Colleins B.V., located at Zoutmanstraat 34, The Hague (no visiting address), registered with the Chamber of Commerce under number 97605611, VAT number NL868131179B01.

  • Customer, you: any natural person acting for purposes unrelated to his or her business or professional activities who enters into a distance contract with Colleins.

  • Agreement: the purchase agreement between Colleins and the customer.

  • Product(s): the dietary supplements offered by Colleins, including Colleins Pink Lemonade (collagen, creatine, and vitamin C powder), as well as any related accessories.

  • Subscription: an Agreement under which Colleins supplies Products on a recurring basis in exchange for periodic payments.

  • Welcome Kit: a one-time gift set (including a tote bag, water bottle, or other items) that can be included with specific promotions or bundles.

  • Website: www.colleins.com and all related subdomains.

  • Business days: Monday through Friday, excluding Dutch and Belgian national holidays.

  • Withdrawal Form: the standard withdrawal form included in Appendix 1 to these terms and conditions.

2. Applicability

2.1 These terms and conditions apply to all offers, orders, and agreements between Colleins and the customer.

2.2 By placing an order, the customer agrees to these terms and conditions.

2.3 Any deviations from these terms and conditions are valid only if expressly agreed to in writing.

2.4 If one or more provisions in these terms and conditions are invalid or are set aside, the remaining provisions shall remain in full force and effect. Colleins will replace the invalid provision with a new provision that corresponds as closely as possible to the purpose and intent of the original provision.

2.5 Colleins reserves the right to amend these terms and conditions. The most recent version is available on the Website at all times. For agreements already entered into, the terms and conditions in effect at the time of conclusion shall continue to apply.

2.6 In addition to these terms and conditions, supplementary terms and conditions apply to the Subscription (Section 13), the Colleins Creator Club Affiliate Program (Section 14), and any B2B relationships. In the event of any conflict, the supplementary terms and conditions shall prevail with respect to the matter in question.

3. Offer and Formation of the Agreement

3.1 All offers on the Website are non-binding and valid while supplies last, unless otherwise stated.

3.2 The Products are depicted as accurately as possible. Product images, colors, and packaging may differ slightly from the actual items. Minor discrepancies do not entitle the customer to cancel the order or receive a refund.

3.3 The Agreement is concluded once the customer has paid for the order and Colleins has sent the order confirmation via email. An automatic confirmation of receipt does not constitute acceptance.

3.4 Colleins reserves the right to refuse orders, cancel them in whole or in part, or impose additional conditions if:

  • there is reasonable doubt as to the accuracy of the information provided;

  • the customer has failed to fulfill payment obligations under previous agreements;

  • there are indications of fraud, misuse of discount codes, or obvious improper use;

  • the Product is unexpectedly out of stock;

  • the order, in Colleins’ reasonable judgment, is not intended for personal use (see Section 12);

  • the delivery address is outside the delivery area served by Colleins.

3.5 If Colleins cancels the order, the customer will be notified immediately. Any amounts already paid will be refunded within 7 business days.

3.6 Pricing errors and obvious mistakes. If the price listed on the Website is clearly incorrect and the customer could reasonably have suspected this, Colleins is not obligated to deliver the Product at that price. In such a case, Colleins will offer the customer the choice of confirming the order at the correct price or canceling it free of charge.

4. Age and Legal Capacity

4.1 To place an order, the customer must be at least 18 years old and legally competent.

4.2 By placing an order, the customer agrees to these terms and conditions.

4.3 If necessary, Colleins may request valid identification to verify the customer’s age.

5. Prices, Payment, and Pay Later

5.1 All prices are in euros and include VAT, unless otherwise stated.

5.2 Shipping costs are listed separately during the ordering process. Shipping within the Netherlands is free for orders that meet the minimum order amount listed on the Website. For orders below this amount, or for shipments to Belgium or other countries, shipping costs may apply in accordance with the rates listed on the Website at the time of ordering.

5.3 Colleins reserves the right to change prices, shipping costs, and shipping thresholds. Price changes do not affect Agreements that have already been confirmed, with the exception of Subscriptions (see Section 13.6).

5.4 Payment is made using one of the payment methods offered at checkout, including iDEAL, Bancontact, credit card, debit card, Apple Pay, Google Pay, PayPal, and pay later via Klarna or in3.

5.5 Pay Later via Klarna and in3. In order to offer payment methods from Klarna or in3, Colleins shares your contact and order information with the relevant provider during checkout so that they can assess whether you are eligible for their payment methods. These payment methods are subject to the terms and conditions and privacy policy of Klarna and in3, respectively. Colleins is not responsible for the processing, credit, or collection by these providers.

5.6 If payment cannot be completed, no Agreement will be formed and the order will be automatically canceled.

5.7 In the event of late payment (if applicable for post-payment arrangements), the customer is automatically in default, and Colleins is entitled to:

  • to charge the statutory interest rate;

  • to charge extrajudicial collection costs in accordance with the Collection Costs Act;

  • to terminate the Agreement.

6. Discounts, promotions, and gifts

6.1 Colleins regularly offers promotions, discount codes, and bundles, including bundles that include a Welcome Kit.

6.2 Unless otherwise specified, discount codes cannot be combined with other discounts, promotions, subscription benefits, or affiliate codes from the Colleins Creator Club program.

6.3 Colleins may change or terminate promotions and offers at any time without prior notice. Promotions are valid while supplies last.

6.4 Misuse of discount codes—including repeated use across multiple accounts, use in violation of the terms and conditions published with the promotion, or unauthorized use by third parties—may result in the cancellation of the order, revocation of the discount, and exclusion from future promotions.

6.5 Welcome Kit and gifts. The Welcome Kit and any other gifts included free of charge with an order have no monetary value of their own and cannot be returned separately for a refund. If an order that included a gift is returned in its entirety, the gift must also be returned in its original and unused condition. If the gift is not returned, or is returned damaged or opened, Colleins is entitled to deduct the retail value of the gift from the refund amount.

7. Delivery and Shipping

7.1 Delivery Area. As of the date of publication of these terms and conditions, Colleins delivers within the Netherlands and Belgium. Delivery to other countries within the European Union may be available on the Website and is subject to the terms and conditions, delivery times, and shipping costs listed there.

7.2 Delivery times are approximate. The delivery times stated on the Website or in communications are approximate and do not constitute a strict deadline. Exceeding an approximate delivery time does not entitle the customer to compensation or termination of the contract, except for the consumer’s statutory rights in the event of late delivery.

7.3 Transfer of Risk. The risk of loss or damage to the Products passes to the customer at the time the Products are delivered to the delivery address provided by the customer or to a pickup location designated by the customer.

7.4 Incorrect address. The customer is required to provide a correct, complete, and valid delivery address. Colleins is not liable for delivery issues, delays, or additional costs resulting from an incorrect or incomplete address.

7.5 Not at home or not picked up. If the customer is not present at the time of delivery, the shipment will be handled in accordance with the delivery service’s procedure. If the package is refused, not picked up within the storage period at the pickup point, or returned to Colleins as undeliverable, Colleins is entitled to deduct a fee of €4.95 for the shipping and return costs incurred from any refund amount or to charge the customer if the customer still wishes to have the item redelivered.

7.6 Out of stock after ordering. If a Product is unexpectedly out of stock after an order has been placed, Colleins will notify the customer within 3 business days and offer an appropriate solution, such as a later delivery, an alternative Product, or a full or partial cancellation with a refund.

7.7 Damaged shipment. If a Product arrives damaged, the customer must report this within 7 days of receipt by emailing support@colleins.com, including the order number and photos of the damage and, if possible, of the outer packaging. Colleins will then provide an appropriate solution, such as a replacement or a (partial) refund.

7.8 Minimum shelf life upon delivery. Colleins strives to deliver Products with a remaining shelf life of at least 6 months from the date of delivery. If a Product is delivered with a shorter remaining shelf life without this having been communicated in advance or reflected as a discount, the customer may return the Product at Colleins’ expense for a refund or replacement.

8. Right of Withdrawal and Returns

8.1 Statutory right of withdrawal (14 days).

8.1.1 The customer has the right to cancel the Agreement without giving any reason within 14 days of receiving the Product.

8.1.2 Pursuant to Article 6:230p(f) of the Dutch Civil Code, the right of withdrawal is excluded for sealed Products that, for reasons of health protection or hygiene, are not suitable for return if the seal has been broken after delivery. This applies to all Colleins dietary supplements. The seal applies to both the outer packaging and the inner seal of the jar or bag.

8.1.3 Products with unbroken seals may be returned within 14 days of receipt, subject to the terms of Section 8.3.

8.2 Extended return policy (30 days) as a commercial warranty.

8.2.1 Without prejudice to the statutory right of withdrawal, Colleins offers an extended 30-day return policy from the date of receipt of the order.

8.2.2 The Product must be returned unopened, undamaged, and in resalable condition, with the seal intact, in its original packaging, and with all accompanying gifts, such as the Welcome Kit (see Section 6.5).

8.3 Return Procedure.

8.3.1 To exercise the right of withdrawal or the extended right of return, the customer must notify us by email at support@colleins.com or by submitting the completed Withdrawal Form (Appendix 1), stating:

  • order number;

  • name of the Product to be returned;

  • Confirmation that the seal is intact.

8.3.2 Colleins will send return instructions within 2 business days and will send a confirmation of receipt immediately.

8.3.3 The customer is responsible for the direct costs of the return shipment. Colleins charges a flat fee of €4.95 for this, which will be deducted from the refund amount, unless Colleins specifies otherwise in writing or the return is due to an error on Colleins’ part (incorrect or damaged Product).

8.3.4 The customer is responsible for ensuring the package is properly packed and for the return shipment until it is received by Colleins. Colleins recommends using a track-and-trace shipping method. Colleins recommends taking a photo of the package with the return label attached before shipping.

8.3.5 The Product must be returned to Colleins within 14 days of submitting the return request.

8.4 Refund.

8.4.1 Upon receipt and approval of the return shipment, Colleins will refund the purchase price without delay, but no later than 14 days after receiving the notice of withdrawal. Colleins may delay the refund until it has received the Products or until the customer has provided proof that the Products have been returned, whichever occurs first.

8.4.2 If the statutory right of withdrawal is exercised within 14 days, the original standard shipping costs from Colleins to the customer will also be refunded. If the extended commercial return policy (days 15 through 30) is exercised, the original shipping costs will not be reimbursed.

8.4.3 Refunds will be issued using the same payment method as the original transaction, unless otherwise agreed. There are no costs associated with the refund for the customer.

8.5 Impairment.

The customer is only liable for any depreciation in the value of the Product resulting from handling that goes beyond what was necessary to determine the nature, characteristics, and functioning of the Product. In the event of damage to the Product, damage to the seal that renders the Product unsellable, or the absence of the original packaging and included gifts, Colleins is entitled to charge for this depreciation or to refuse the return. The customer will be informed of this in advance.

9. Conformity and Legal Warranty

9.1 Colleins warrants that the Products comply with the Agreement, with the specifications listed on the Website and on the label, and with reasonable standards of quality and fitness for purpose.

9.2 The Products comply with all legal requirements applicable to dietary supplements in the Netherlands and the European Union, including Regulation (EC) No. 178/2002, Regulation (EC) No. 1924/2006 (health and nutrition claims), and Regulation (EU) No. 1169/2011 (food information to consumers). Colleins is supervised by the NVWA.

9.3 The statutory period of conformity for consumers under Section 7:17 of the Dutch Civil Code applies. For dietary supplements, this period of conformity applies until the expiration date stated on the packaging, provided the Product has been stored in accordance with the storage instructions.

9.4 Rights under the statutory warranty shall lapse if:

  • the Product was not used in accordance with the instructions;

  • the Product has been stored improperly, contrary to the storage instructions on the packaging;

  • the expiration date listed on the packaging has passed;

  • the customer has broken the seal and the Product has not been used or stored in accordance with the instructions.

10. Complaints

10.1 Complaints regarding the Products or the performance of the Agreement must be submitted in full and clearly described within a reasonable time after the customer has discovered the defect. In the case of a consumer purchase, a report submitted within 2 months of discovery is generally considered timely. Complaints may be submitted via support@colleins.com, stating the order number, a description of the complaint, and, where possible, photos.

10.2 Colleins will acknowledge receipt of the complaint without delay and will address it within 14 days of receipt. If it is expected to take longer to resolve the complaint, Colleins will inform the customer and provide an estimate of when a substantive response can be expected.

10.3 If the complaint is valid, Colleins will, at its discretion and in consultation with the customer, offer an appropriate solution, such as a replacement, repair, or a full or partial refund.

10.4 Filing a complaint does not relieve the customer of their obligation to pay, except for statutory rights to suspend payment.

11. Product Information and Use

1.1 Supplement Status. Colleins Pink Lemonade is a dietary supplement and is not a substitute for a varied, balanced diet and a healthy lifestyle. The Products are not medicines and are not intended to diagnose, treat, cure, or prevent any disease. Colleins makes no medical claims beyond the permitted health claims in accordance with Regulation (EU) No. 432/2012.

11.2 Recommended use. The recommended daily dose is listed on the packaging and is 1 scoop (approximately 10 grams) per day, dissolved in 300 to 500 ml of water. Do not exceed the recommended dose unless advised by a doctor or healthcare professional.

11.3 Warnings and Contraindications. The Product is not suitable for:

  • vegetarians and vegans (contains bovine collagen);

  • people who are allergic to beef or to any of the other ingredients;

  • children under the age of 18, unless otherwise advised by a doctor.

Consult a doctor or healthcare professional before use if you are pregnant, breastfeeding, taking medication, under medical supervision, or have a chronic condition.

11.4 Storage Instructions. Store the Product in its tightly sealed original packaging at room temperature (15 to 25 degrees Celsius), away from direct sunlight and heat, and out of the reach of children.

11.5 Shelf Life. The expiration date is printed on the packaging. Do not use the Product after this date. Stop use immediately and consult a doctor if you experience side effects, adverse reactions, or allergic symptoms.

11.6 Allergen Information. The Product contains bovine collagen. Based on the formulation, the Product does not contain peanuts, soy, fish, crustaceans, mollusks, tree nuts, celery, mustard, sesame seeds, lupin, milk, eggs, gluten, or sulfites. For the current and complete list of ingredients and allergen declaration, including any cross-contamination risks from the production environment, please refer to the label on the packaging and the product page on the Website.

12. Prohibition on Resale and Commercial Use

12.1 The Products are offered exclusively for personal use by consumers. The customer is not permitted to use the Products purchased through the Website for resale, distribution, commercial supply, sale through online marketplaces (including Bol, Marktplaats, Amazon, Vinted, and similar platforms), to third parties in physical stores, or in any other commercial capacity.

12.2 Colleins reserves the right to refuse orders, suspend or terminate accounts, and cancel orders that have already been placed if, in Colleins’ reasonable judgment, there are indications that the Products were purchased in violation of this section. Indications may include, but are not limited to: orders in unusual quantities, repeated orders to a single delivery address, the use of business information, or messages or advertisements indicating resale.

12.3 Businesses and entrepreneurs who wish to sell or distribute Colleins Products may contact us at partners@colleins.com to enter into a separate B2B agreement. B2B relationships are governed by separate terms and conditions, not these consumer terms and conditions.

13. Subscriptions

13.1 If Colleins offers a Subscription on the Website, the customer may choose to receive Products on a recurring basis in exchange for periodic payments. In addition to the other provisions of these terms and conditions, the provisions of this section apply to the Subscription.

13.2 When signing up for a Subscription, the customer agrees to make a one-time initial payment at the time of ordering, followed by automatic recurring payments at the selected frequency (for example, every 30, 60, or 90 days). The customer remains responsible for all recurring payments made prior to a valid cancellation.

13.3 The first delivery will take place shortly after the first payment is made. Subsequent deliveries will be scheduled based on the shipping date of the previous subscription order and the selected frequency.

13.4 Cancellation. The customer may cancel the Subscription at any time via the customer account or by sending an email to support@colleins.com. A cancellation takes effect as of the next subscription cycle, provided the cancellation is received before the next billing date. Orders that have already been charged and entered into production will still be fulfilled. If the customer wishes to terminate the Subscription immediately after a charge, this can be processed upon request by exercising the right of withdrawal or the extended right of return as described in Article 8.

13.5 Pausing or adjusting. To the extent that the Website offers this functionality, the customer may postpone a delivery date or adjust the frequency, provided this is done before the next billing date.

13.6 Price Changes. Colleins may change the price of a Subscription. The customer will be notified of any price change via email at least 30 days before the next payment is charged. If the customer does not agree to the new price, the Subscription may be canceled free of charge before the next payment is charged.

13.7 Availability and Non-Renewal. All subscription orders are subject to availability. Colleins reserves the right not to renew a Subscription at any time, without providing a reason. In such a case, Colleins will notify the customer in a timely manner, and any amounts already paid in advance will be refunded on a pro rata basis.

13.8 Failed payment. If a recurring payment fails, Colleins is entitled to attempt the payment again within 7 days. The customer will be notified of this by email. If payment is not received, Colleins is entitled to suspend delivery or terminate the Subscription.

14. Affiliate Program (Colleins Creator Club)

14.1 The Colleins Creator Club (CCC) program is Colleins’ affiliate program for creators and influencers. Participation is by invitation or after registering through the designated channels.

14.2 Participation in the CCC is subject to separate terms and conditions for participants, which are provided upon admission to the program. These terms and conditions include provisions regarding commission structure, attribution, payment terms, rules of conduct, and termination.

14.3 Affiliate codes and special discount codes from the CCC cannot be combined with other discount promotions, unless otherwise specified.

14.4 Colleins reserves the right to adjust or cancel commissions and discounts in the event of suspected or confirmed fraud, misuse, self-targeting (an affiliate using their own code for their own purchases), or other violations of the CCC Terms and Conditions.

15. Reviews and user-generated content (UGC)

15.1 Colleins appreciates it when customers share reviews, photos, or videos about their experience with the Products. By posting a review on the Website, tagging Colleins on social media alongside content in which the Product is visible or mentioned, or submitting content via a campaign or form organized by Colleins, the customer grants Colleins a worldwide, non-exclusive, royalty-free, sublicensable, and unlimited license to use, edit, reproduce, publish, distribute, and exploit that content in all media and for all marketing and commercial purposes of Colleins, including advertisements on Meta, TikTok, YouTube, email, the Website, and print.

15.2 The customer warrants that he or she holds all necessary rights to the shared content, that the content does not infringe upon the rights of third parties (including the right of publicity, copyright, and trademark rights), and that all individuals recognizable in the content have given their consent to the aforementioned use.

15.3 To the extent permitted by law, the customer waives any moral rights that might prevent Colleins from using the content, provided that Colleins may, where reasonable and appropriate, mention the customer’s name or social media handle.

15.4 Colleins reserves the right to refuse or remove reviews or user content that is unlawful, offensive, defamatory, misleading, irrelevant, in violation of the law, or in violation of these terms and conditions, or that contains medical claims, contact information, or references to other online stores.

16. Liability

16.1 Colleins is liable only for damages that are the direct result of a culpable breach of the Agreement.

16.2 In any event, Colleins shall not be liable for:

  • indirect damages, consequential damages, lost profits, lost savings, data loss, and business interruption damages;

  • damage caused by improper use of the Product or failure to follow the instructions and warnings;

  • damage resulting from the use of the Product in combination with medications or other supplements without prior medical advice;

  • health problems or allergic reactions in individuals who belong to one of the risk groups listed in Article 11.3 and who have not sought medical advice;

  • damage caused by use after the expiration date or by improper storage.

16.3 In all cases, Colleins’ total liability is limited to no more than the purchase price of the Product in question, excluding shipping costs.

16.4 The limitations set forth in this section do not apply in cases of willful misconduct or gross negligence on the part of Colleins or its officers, nor do they apply to statutory product liability under Section 6:185 of the Dutch Civil Code and subsequent provisions, or in cases of death or bodily injury caused by a defect in the Product.

16.5 Customer Responsibility. The customer is solely responsible for determining whether the Product is suitable for his or her personal situation, for seeking medical advice where applicable, and for correctly following the instructions for use and storage. By placing an order, the customer confirms that he or she has read the instructions for use and warnings.

16.6 Force Majeure. Colleins shall not be obligated to fulfill any obligation if it is prevented from doing so by force majeure. Force majeure is defined as any circumstance beyond Colleins’ control that prevents fulfillment in whole or in part, including war, riots, government measures, strikes, disruptions to electricity, internet, telecommunications, or payment systems, transportation issues, delays or failures on the part of suppliers, fire, flooding, pandemics, and problems or outages at fulfillment, payment, or delivery partners. In the event of force majeure, Colleins may suspend the Agreement or terminate it in whole or in part without being liable for any compensation.

17. Intellectual Property

17.1 All intellectual property rights relating to the Website, the Colleins brand name, the logo, product photos, text, videos, and other material published by Colleins are owned by Colleins or its licensors.

17.2 No material belonging to Colleins may be reproduced, disclosed, or commercially exploited without Colleins’ prior written consent, except for personal, non-commercial use and except as permitted under the CCC program (Article 14).

17.3 The following is expressly prohibited:

  • use the brand name Colleins or similar marks in domain names, social media handles, or advertisements without written permission;

  • creating content that falsely gives the impression that it was created by or on behalf of Colleins;

  • make false, defamatory, or misleading statements that could damage Colleins’ reputation.

17.4 Article 15 applies to the license that the customer grants to Colleins for content shared by the customer.

18. Privacy and Data Protection

18.1 Colleins processes customers’ personal data in accordance with the General Data Protection Regulation (GDPR) and Colleins’ Privacy Policy, which is published on the Website.

18.2 To process orders, payments, and deliveries; provide customer service; conduct marketing (to the extent permitted based on consent or legitimate interest); and enforce these terms and conditions, personal data is shared with, among others, payment providers (Mollie, Shopify Payments, Klarna, in3), the fulfillment partner, delivery services, email marketing platforms, and analytics service providers. An up-to-date overview of recipient categories is provided in the Privacy Policy.

19. Governing Law and Disputes

19.1 All Agreements between Colleins and the customer are governed by Dutch law. The applicability of the Vienna Convention on Contracts for the International Sale of Goods (CISG) is excluded.

19.2 Belgian consumers. If the customer resides in Belgium and Belgian consumer law provides him or her with greater protection under mandatory provisions than Dutch law, the Belgian customer may invoke those mandatory provisions.

19.3 The parties agree to first attempt to resolve any disputes through mutual consultation. The customer may initially submit complaints to support@colleins.com.

19.4 The customer may also submit his or her dispute to the European Commission’s Online Dispute Resolution platform via https://ec.europa.eu/consumers/odr.

19.5 If the parties are unable to resolve the dispute through mutual agreement, the dispute may be submitted to the competent court. The District Court of The Hague shall have exclusive jurisdiction, unless the law mandatorily designates another court, in which case the court with statutory jurisdiction shall have jurisdiction.

20. Final Provisions

20.1 These terms and conditions also apply to any supplementary or subsequent agreements with the customer.

20.2 Colleins is entitled to transfer its rights and obligations under the Agreement to a third party in connection with a merger, acquisition, or reorganization, while preserving the customer’s rights.

20.3 The customer may not assign any rights or obligations under the Agreement to third parties without Colleins’ prior written consent.

20.4 If any provision of these terms and conditions is found to be invalid or voidable, the remaining provisions shall remain in full force and effect. The invalid or voidable provision shall be replaced by a valid provision that corresponds as closely as possible to the purpose and intent of the original provision.
