1. Definitions
In these general terms and conditions, the following definitions apply:
●Colleins / we / us: Colleins B.V., located at Zoutmanstraat 34, The Hague, registered with the Chamber of Commerce under number 97605611, VAT number: [INSERT VAT NUMBER]
●Customer / you: any natural or legal person who enters into a distance agreement with Colleins
●Agreement: the purchase agreement between Colleins and the customer
●Product(s): the supplements offered by Colleins, including Colleins Pink Lemonade (collagen, creatine, and vitamin C powder)
●Website: www.colleins.com and all related subdomains
●Working days: Monday through Friday, except national holidays
2. Applicability
2.1 These general terms and conditions apply to all offers, orders, and agreements between Colleins and the customer.
2.2 By placing an order, the customer agrees to these terms and conditions.
2.3 Deviations from these terms and conditions are only valid if expressly agreed in writing.
2.4 If one or more provisions in these general terms and conditions are invalid or void, the remaining provisions will remain in force. Colleins will replace the invalid provision(s) with new provisions that correspond as closely as possible to the purpose and meaning of the original provision(s).
2.5 Colleins reserves the right to amend these general terms and conditions. The most recent version is available on the website at all times. Agreements that have already been concluded remain subject to the terms and conditions that applied at the time the agreement was concluded.
3. Offer and conclusion of agreement
3.1 All offers on the website are non-binding and subject to availability, unless otherwise stated.
3.2 Colleins cannot be held liable for obvious errors or mistakes in the offer, such as incorrect prices, product descriptions, or images.
3.3 The agreement is concluded at the moment the customer has placed the order and Colleins has sent an order confirmation by email.
3.4 Colleins reserves the right to refuse or cancel orders if:
●There are reasonable doubts about the accuracy of the information provided.
●The customer has failed to meet payment obligations from previous agreements.
●There is abuse, fraud, or evident improper use.
●The product unexpectedly turns out to be out of stock.
3.5 In the event of cancellation by Colleins, the customer will be notified immediately. Any amounts already paid will be refunded within 7 working days.
4. Age and authority
4.1 To place an order, the customer must be at least 18 years of age and legally competent.
4.2 By placing an order, the customer declares that they agree to these terms and conditions.
4.3 Persons under the age of 18 may only order products with the express consent of a parent or guardian.
5. Prices and payment
5.1 All prices on the website are expressed in euros and include VAT, unless stated otherwise.
5.2 Shipping costs are not included in the product price and are stated separately during the ordering process. Shipping is free for orders over €50.00. For orders below this amount, shipping costs are €4.95 within the Netherlands.
5.3 For deliveries within the European Union, different shipping costs apply, which are shown during the ordering process.
5.4 Colleins reserves the right to change prices. Price changes do not affect agreements that have already been concluded.
5.5 Payment must be made immediately when placing the order using one of the payment methods offered:
●Shopify Payments (credit card, debit card)
●Mollie (iDEAL, Bancontact, PayPal, Apple Pay, Google Pay)
●Pay later (if available, such as Klarna or in3)
5.6 When using "pay later," the terms and conditions of the relevant payment provider apply. Colleins is not responsible for processing these payments.
5.7 If payment cannot be completed, the order will be automatically canceled and no agreement will be concluded.
5.8 In the event of late payment (if applicable in the case of payment after delivery), the customer shall be in default by operation of law and Colleins reserves the right to:
●Charge statutory (commercial) interest
●Charge extrajudicial collection costs (minimum €40.00)
●Terminate the agreement
6. Discounts and promotions
6.1 Colleins regularly offers discounts and promotions, such as the "3+2 Launch Deal," which includes extra products or gifts (such as a tote bag and water bottle).
6.2 Discount codes cannot be combined, unless explicitly stated otherwise.
6.3 Colleins reserves the right to change or terminate promotions and offers at any time without prior notice.
6.4 Promotions and discounts are valid only while supplies last.
6.5 Free gifts with promotions (such as tote bags and water bottles) are included with the order and cannot be returned separately for a refund.
6.6 Misuse of discount codes may result in cancellation of the order.
7. Delivery and shipping
7.1 Delivery area
Colleins currently delivers within:
●The Netherlands
●European Union (in expansion)
7.2 Delivery times in the Netherlands
Monday through Friday:
●Ordered before 11:59 p.m. = delivered the next business day
Saturday and Sunday:
●Ordered before 11:59 p.m. = delivered on Monday
7.3 Delivery times European Union
A cut-off time of 10:00 p.m. applies to all EU countries. Indicative delivery times are:

7.4 The delivery times stated are indicative. Colleins cannot be held liable for delays caused by the delivery service, weather conditions, customs, or other circumstances beyond its control.
7.5 The risk of loss or damage to products is transferred to the customer at the moment the products are delivered to the customer at the specified delivery address.
7.6 The customer is obliged to provide a correct and complete delivery address. Colleins is not liable for delivery problems resulting from an incorrectly provided address.
7.7 If the customer is not at home at the time of delivery, the shipment will be handled in accordance with the delivery service's procedure (usually: delivery to neighbors, pickup point, or depot notification). Any costs for redelivery will be borne by the customer.
7.8 If a product is unexpectedly out of stock after the order has been placed, Colleins will notify the customer within 3 working days and, in consultation with the customer, offer a suitable solution, such as:
●Waiting for new stock
●Offer an alternative product
●Full or partial cancellation with refund
7.9 Damaged shipment
7.10 If a product arrives damaged, the customer must report this immediately via support@colleins.com, stating the order number and providing photos of the damage. Colleins will consult with the customer to offer a suitable solution, such as replacement or refund.
8. Right of withdrawal and returns
8.1 Legal right of withdrawal (14 days)
8.1.1 The customer has the right to terminate the agreement without giving reasons within 14 days of receiving the product.
8.1.2 The following are excluded from the right of withdrawal:
●Sealed products that have been unsealed after delivery and cannot be returned for hygienic or health protection reasons (Article 6:230p sub c of the Dutch Civil Code)
●This means that Colleins products can only be returned if the seal is still intact.
8.2 Extended right of return (30 days)
8.2.1 Colleins offers an extended right of return of 30 days after receipt of the order.
8.2.2 The product must be returned unopened and undamaged, including the original packaging and any accessories.
8.2.3 The product seal must still be completely intact. Opened products cannot be returned for hygiene reasons.
8.3 Return procedure
8.3.1 To exercise the right of return, the customer must contact support@colleins.com, stating:
●Order number
●Reason for return
●Confirmation that the product is unopened
8.3.2 Colleins will provide return instructions within 2 business days.
8.3.3 The customer shall bear the return costs and is responsible for proper packaging and shipping.
8.3.4 Colleins recommends using track & trace shipping. The risk during return shipping lies with the customer.
8.3.5 The product must be returned to Colleins within 14 days of notifying Colleins of the return request.
8.4 Refund
8.4.1 Upon receipt and approval of the return shipment, Colleins will refund the full purchase price excluding shipping costs within 7 to 10 business days.
8.4.2 Refunds will be made in the same manner as the payment was made, unless expressly agreed otherwise.
8.4.3 If the product does not meet the return conditions (for example: opened, damaged, incomplete), Colleins reserves the right to refuse the return or to refund a reduced amount. The customer will be notified of this in advance.
8.5 Exceptions
8.5.1 Products that are explicitly excluded from return on the product page (if applicable) cannot be returned.
8.5.2 Personalized products or products that are customized for the customer are excluded from return.
8.6. If the product is damaged or the packaging is damaged more than is necessary to try the product, we may charge you for this reduction in value of the product. Therefore, please handle the product with care and ensure that it is properly packaged when returning it.
9. Conformity and warranty
9.1 Colleins guarantees that the delivered products comply with the agreement and meet the specifications stated in the offer.
9.2 The products comply with the legal requirements, EU directives, and quality standards that apply to dietary supplements in the Netherlands.
9.3 Colleins does not offer any additional warranty beyond the statutory warranty as described in Article 7:17 of the Dutch Civil Code. The statutory warranty period is two years after delivery for consumers.
9.4 If a product has a defect that was already present at the time of delivery, the customer is entitled to free repair, replacement or, if that is not possible, an appropriate price reduction or termination of the agreement.
9.5 Rights under warranty shall lapse if:
●The product was not used according to the instructions for use.
●The product has been stored incorrectly (not according to the instructions on the packaging).
●The expiration date has passed.
●The seal has been broken by the customer and the product has subsequently been used incorrectly.
10. Complaints
10.1 Complaints about the products or delivery must be reported in writing to support@colleins.com as soon as possible, but no later than two months after discovery of the defect, stating:
●Order number
●Description of the complaint
●Photos (if applicable)
10.2 Colleins will process the complaint within 14 days of receipt and keep the customer informed of the progress.
10.3 If the complaint is justified, Colleins will, at its discretion:
●Replacing the product
●Refund the purchase price (in full or in part)
●Offer another suitable solution
10.4 Submitting a complaint does not release the customer from their payment obligation.
10.5 Complaints about the performance of the agreement must be submitted to Colleins within a reasonable time after the customer has discovered the defects, fully and clearly described.
11. Product information and instructions for use
11.1 Supplement status
11.1.1 Colleins Pink Lemonade is a dietary supplement and is not a substitute for a varied, balanced diet and a healthy lifestyle.
11.1.2 Colleins products are not medicines and should not be considered as such.
11.1.3 Colleins does not make any medical claims about the efficacy of its products beyond the permitted health claims in accordance with EU Regulation 432/2012.
11.2 Recommended use
11.2.1 The recommended daily dose is 1 scoop (±10 grams) per day, dissolved in 300-500 ml of water.
11.2.2 The recommended dosage should not be exceeded unless advised by a doctor or healthcare professional.
11.3 Warnings and contraindications
11.3.1 The product is not suitable for:
●Vegetarians and vegans (contains bovine collagen)
●People with an allergy to beef
●Children under the age of 18 (unless on medical advice)
11.3.2 Consult a physician or healthcare professional before use if:
●You are pregnant or breastfeeding
●You are taking medication
●You are undergoing medical treatment
●You have a chronic condition
●You are allergic to any of the ingredients.
11.3.3 Storage instructions:
●Store in a tightly closed container.
●Store at room temperature (15-25°C).
●Keep away from direct sunlight and heat
●Keep out of reach of children.
11.3.4 Expiration date: 24 months after production date if stored correctly. Do not use the product after the expiration date.
11.3.5 Stop using immediately and consult a doctor if:
●Side effects or adverse reactions
●Allergic reactions
●Health complaints
11.4 Allergen information
11.4.1 The product contains bovine collagen and is therefore not suitable for vegetarians and vegans.
11.4.2 The product does not contain any of the following allergens: peanuts, soy, fish, shellfish, mollusks, nuts, celery, mustard, sesame seeds, lupine, milk, eggs, gluten, sulfites.
11.4.3 For complete ingredient information, please refer to the label on the packaging and the product page on the website.
12. Liability
12.1 Limitation of liability
12.1.1 Colleins is only liable for damage that is the direct result of an attributable failure to fulfill the agreement.
12.1.2 Colleins is not liable for:
●Indirect damage, including consequential damage, lost profits, lost savings, loss of data, and damage due to business interruption
●Damage resulting from improper use of the product
●Damage resulting from failure to follow instructions and warnings
●Damage caused by using the product in combination with medication or other supplements without prior medical advice
●Allergic reactions or health complaints that arise in persons who use the product while belonging to one of the risk groups as described in Article 11.3.
●Damage caused by the customer using the product after its expiration date
●Damage caused by improper storage of the product
12.1.3 Colleins' liability is in all cases limited to a maximum of the purchase price of the product in question (excluding shipping costs).
12.1.4 This limitation does not apply in the event of intent or gross negligence on the part of Colleins.
12.2 Customer's own responsibility
12.2.1 The customer is responsible for:
●Assessing whether the product is suitable for his/her personal situation
●Seeking medical advice where applicable
●Correctly following the instructions for use
●Store the product according to the instructions.
12.2.2 By placing an order, the customer declares:
●Have read and understood the instructions for use and warnings
●Not belonging to one of the risk groups, or having sought medical advice
●Use the product at your own risk
12.3 Force majeure
12.3.1 Colleins is not obliged to fulfill any obligation if it is prevented from doing so as a result of force majeure.
12.3.2 Force majeure is understood to mean: any circumstance beyond Colleins' control that prevents it from fulfilling its obligations to the customer in whole or in part. This includes, but is not limited to:
●War, riots, mobilization, domestic and foreign unrest, government measures, strikes
●Power, internet, or telecommunications outages
●Transportation issues, delays at suppliers
●Fire, flooding, pandemics, and other natural disasters
●Failure of own business resources or problems with fulfillment partners
12.3.3 In the event of force majeure, Colleins has the option to suspend the agreement or to terminate it in whole or in part without being liable for any compensation.
13. Intellectual property
13.1 All intellectual property rights relating to the website, the brand name "Colleins," the logo, product photos, texts, videos, and other material are owned by Colleins or its licensors.
13.2 It is not permitted to reproduce, publish, or exploit any material without Colleins' prior written consent, except for personal use.
13.3 Use on social media:
●Customers may share product photos and content on their personal social media accounts.
●Sharing positive experiences and product photos is encouraged.
●For commercial use (e.g., affiliate marketing or paid promotion), prior permission must be obtained from Colleins.
13.4 It is not permitted to:
●Using the brand name "Colleins" in domain names or social media handles without permission
●Creating misleading content as if it were officially created by Colleins
●Making negative or defamatory statements that damage Colleins' reputation
14. Privacy and data protection
14.1 Colleins processes customers' personal data in accordance with the General Data Protection Regulation (GDPR) and Colleins' privacy policy.
14.2 For more information about how Colleins handles personal data, please refer to the Privacy Policy on the website.
14.3 By placing an order, the customer consents to the processing of personal data as described in the privacy policy.
15. Applicable law and disputes
15.1 All agreements between Colleins and the customer are governed by Dutch law.
15.2 The applicability of the Vienna Sales Convention (CISG) is expressly excluded.
15.3 The parties undertake to first attempt to resolve any disputes through mutual consultation.
15.4 If the parties fail to resolve the dispute through mutual consultation, they will first attempt to resolve the dispute through mediation in accordance with the rules of the Dutch Mediation Federation (NMF) or a comparable mediation institution.
15.5 Only if mediation does not lead to a solution may the parties submit the dispute to the competent court.
15.6 The District Court of The Hague has exclusive jurisdiction to hear disputes between Colleins and the customer, unless the law mandatorily designates another court.
15.7 Consumers retain the right to refer the matter to the Online Shopping Disputes Committee (www.degeschillencommissie.nl) within 12 months of the dispute arising.
15.8 In the event of complaints, consumers should first contact the entrepreneur. If the online store is affiliated with WebwinkelKeur and complaints cannot be resolved through mutual consultation, consumers should contact WebwinkelKeur (www.webwinkelkeur.nl), which will mediate free of charge. Check whether this online store has a current membership via https://www.webwinkelkeur.nl/leden/. If a solution cannot be reached, the consumer has the option of having their complaint handled by the independent disputes committee appointed by WebwinkelKeur. The decision of this committee is binding, and both the entrepreneur and the consumer agree to this binding decision. Submitting a dispute to this disputes committee involves costs that must be paid by the consumer to the committee in question.
16. Final provisions
16.1 These general terms and conditions also apply to supplementary and follow-up agreements with the customer.
16.2 Colleins is entitled to amend these general terms and conditions. The amended terms and conditions will be published on the website. Agreements that have already been concluded will remain subject to the terms and conditions that were applicable at the time the agreement was concluded.
16.3 If any provision of these general terms and conditions is void or voidable, this shall not affect the validity of the remaining provisions. The void or voidable provision shall be replaced by a provision that corresponds as closely as possible to the purpose and meaning of the original provision.
16.4 Colleins is entitled to transfer its rights and obligations under the agreement to a third party.
16.5 The customer is not entitled to transfer rights and obligations under the agreement to third parties without Colleins' prior written consent.
